On October 28, HACC issued a decision for actual imprisonment of the former head of JSC “State Food and Grain Corporation of Ukraine”.
The court sentenced the defendant to 3.5 years in prison. According to the court’s decision, the convict must pay a fine to the state and is banned from holding management positions for three years.
This is the first time in history that HACC has issued a real prison sentence under a plea agreement; previous verdicts had favored suspended sentences.
Recall that the conviction stemmed from the JSC “SFGCU” director’s abuse of official position, through which he managed to misappropriate state property (grain) worth almost 15 million hryvnias. During the investigation, the former director admitted his guilt and entered into a plea agreement. Thus, according to Part 2 of Article 364 of the Criminal Code of Ukraine, the ex-head was found guilty of committing a crime against the state and sentenced to 3.5 years in prison instead of six.
Thanks to the plea agreement, the accused received only half of the punishment prescribed by the article. This case proves that the institution of plea agreements in Ukraine actually works.
