On May 21, the investigation changed the suspicion of the main defendant in the Sheremet case.

Now, according to the new version of the investigation, the organizers of Sheremet’s murder are unknown individuals who, acting for a number of their own motives, decided to create an extremely resonant event in order to further provoke numerous protests. Let us recall that earlier the investigation called Andriy Antonenko the organizer of the murder, and the motive for the crime was noted as Antonenko’s fascination with “nationalist ideas” and “the greatness of the Aryan race.”

According to the amended suspicion, Mr. Antonenko is now not the organizer, but a simple executor under a previous conspiracy. Ms. Kuzmenko now only planted the explosives together with Antonenko, but did not pull the trigger, and Yana Duhar is their accomplice. Also added are 2 more articles of indictment: destruction of a Subaru car and possession of explosives.

At the same time, a motion was filed to extend preventive measures in the form of detention for Mr. Antonenko and Ms. Kuzmenko, and to change the house arrest for Ms. Dugar to a bail of 168 thousand UAH. The latter is due to the fact that it is prohibited to keep a person under house arrest for more than 6 months (Part 6 of Article 181 of the Criminal Procedure Code).

During 2016, persons not yet identified by the investigation, materials regarding which have been allocated to a separate proceeding, acting for a number of personal motives, decided to create an extremely resonant event in society with the aim of further provoking numerous protests. The most effective option for implementing the above was the organization of a premeditated crime related to the murder of one of the public figures in the territory of Kyiv. In achieving this goal, the above-mentioned persons not yet identified by the investigation, during 2016, but no later than 15.07.2016, a criminal intent arose to implement the above-mentioned plans by organizing a crime that requires careful and long-term preparation.

Understanding that the persons who are not currently identified by the investigation are unable to independently organize the commission of the specified crime, the latter, during the specified period, decided to involve certain individuals from among the volunteer groups of the population in the implementation of the planned criminal activity as accomplices, organize them under their leadership and create a stable association to ensure thorough long-term preparation and commission of the specified crime, united by a single plan with the distribution of functions of the group members, aimed at achieving this plan, known to all group members.

While performing the assumed functions of organizing the commission of the crime, the specified unidentified persons during 2016, but no later than 07/15/2016, determined the object of the criminal encroachment – the life and health of journalist Sheremet Pavlo Grigorovich, born on November 28, 1971.

The choice of Sheremet P.G. as the object of the criminal attack was, among other things, related to his fame and media coverage, and by killing such a person it was possible to achieve the above-mentioned goal of the criminal intent.

Considering that a significant number of people are needed to carry out the specified criminal activity, persons who have not been identified by the investigation at this time, began a search for accomplices in the crime, which was guided by the following criteria: the inclination of individuals with strong-willed traits to violent actions, low moral and psychological qualities.

The following persons responded to the above offer for personal reasons: Antonenko Andriy Serhiyovych, born on October 2, 1971, Kuzmenko Yulia Leonidivna, born on November 5, 1979, Dugar Yana Serhiyivna, born on November 22, 1993, and other unidentified persons.

The personal motives of the above-mentioned individuals (Kuzmenko Yu.L., Antonenko A.S., Dugar Ya.S.) consisted in supporting the idea of ​​individuals who have not been identified by the investigation at this time, creating an extremely resonant event in society with the aim of further provoking numerous protests.

Aware of the socially dangerous and unlawful nature of their actions, participation in a criminal organization, Antonenko A.S., Kuzmenko Y.L., Dugar Y.S. and other persons not currently identified by the investigation, during 2016, but no later than July 15, 2016, agreed to the proposal of persons not currently identified by the investigation to commit a particularly serious crime against the life and health of a person as part of an organized group.

Subsequently, persons not yet identified by the investigation, acting as organizers and leaders of the organized group, in order to ensure the existence of the specified entity, took on the function of providing financing for both the activities of the criminal association as a whole and the financing of expenses related to the commission of a separate crime by its participants, which consisted in allocating funds for the manufacture and purchase of instruments of the crime (homemade explosive devices, mechanisms for their activation) and means of conspiracy.

Being familiar, among other things, with the methods of law enforcement agencies, persons who have not been identified by the investigation at this time, acting as organizers and leaders of an organized group, ensured the concealment of the illegal activities of the criminal group, defining clear rules of conspiracy among its participants, and planned the destruction and concealment of material evidence in order to make it impossible to expose criminal activity.

When carrying out the activities of an organized group by persons currently unidentified by the investigation, its participants were required to comply with the rules of conspiracy of each person’s actions, instructions were given to persons who directly committed the crime and ensured its execution, and the places of preparation for committing the crime, as well as the places where weapons and explosive devices were stored, were maximally masked.

In addition, the participants of the organized group, persons not yet identified by the investigation, were required to conduct veiled communication in telephone conversations using messengers based on social networks, in order to prevent their conversations from being listened to and their criminal activities from being exposed by law enforcement agencies. Namely, during communication using mobile terminals of communication systems, special terminology, previously agreed upon between them, was used and fictitious pseudonyms were used.

Also, persons not identified by the investigation at this time, acting intentionally with the above-mentioned purpose as organizers and leaders of the organized group, developed a single plan and method of committing the crime for all participants of the group – by blowing up the car used by P.H. Sheremet, they brought the above to the attention of all participants of the criminal organization.

Performing the duties of the leader of the criminal organization, a person who has not been identified by the investigation at this time, distributed functions among the group members according to a jointly developed plan to murder Sheremet P.G. by blowing up a car, guided by the above-mentioned criteria for selecting members of the criminal organization:

  • Antonenko A.S., Kuzmenko Y.L., and other unidentified persons, as persons who visited the anti-terrorist operation zone in Eastern Ukraine and who had skills in using weapons, were entrusted with the function of directly committing the intentional murder of Sheremet P.H. using improvised explosive devices;
  • Dugar Ya.S. and other persons not identified by the investigation at this time were entrusted with the functions of carrying out visual surveillance of Sheremet P.H. in order to establish his location and residence, the means of transport used by the latter, studying his daily routine, style and lifestyle, the presence of security, examining the crime scene in order to determine the routes of the conspiratorial departure of the perpetrators of the murder and the manufacture of the instruments of the crime – homemade explosive devices.

Among the participants subordinate to the leader of the organized group, a person who has not been identified by the investigation at this time, there were certain individuals with administrative and economic functions (accomplices who provided the necessary property, vehicles, weapons and explosive devices for the commission of the crime) and the main composition of the active direct perpetrators of the crime, that is, the structure of the criminal association was formed, which changed towards unity and stability as ties between the participants were established.

Each member of the organized group was aware of the nature of his unlawful actions and the actions of other members of the criminal group, the goals set by the person who has not been identified by the investigation at this time, the purpose of the creation and existence of the organized group, desired to achieve a single intention and contributed to the desired criminal result in the form of committing a crime that requires careful and long-term preparation.

In the process of forming an organized group, individuals who were aware of the existence of an association of people for activities against the existing state system and law and order were organized into it. Being aware of the fact of the implementation of illegal activities on the territory of Kyiv, such individuals, by joining the group, thereby consented to participate in such an association and confirmed the reality of their intentions by certain actions during the preparation and commission of the crime – premeditated murder.

Thus, during 2016, but no later than 07/15/2016, persons not yet identified by the investigation, formed an organized group in the territory of Kyiv, which included the specified persons personally, Antonenko A.S., Kuzmenko Yu.L., Dugar Ya.S. and other persons not yet identified by the investigation, united by a single criminal plan proven to everyone with a clear division of functions, in order to achieve the goal of this criminal association – the commission of a particularly serious crime that requires careful long-term preparation – the murder of Sheremet P.G.

Thus, persons not yet identified by the investigation, acting as organizers and leaders of the specified organized group, performing the assumed functions of organizing the premeditated murder, during 2016, but no later than 07/15/2016, brought to the direct perpetrators of the crime (Antonenko A.S., Kuzmenko Y.L. and other unidentified persons) and accomplices (Dugar Y.S. and other unidentified persons) information about the place of residence of Sheremet P.G. – house No. 12 on Ivan Franko Street in Kyiv, and the vehicle used by the latter – a Subaru car of the model “XV” with the license plate “AA1273EE”.

Subsequently, persons not yet identified by the investigation, acting as organizers and leaders of the aforementioned organized group, performing the functions assumed in organizing the premeditated murder, during 2016, but no later than 07/15/2016, instructed Dugar Ya.S. and other persons not yet identified by the investigation to establish the exact parking location of the vehicle used by the latter, and to conduct reconnaissance of the scene of the premeditated murder in order to determine the conspiratorial routes of movement (approach and departure) of the perpetrators, and to determine the locations of external video surveillance cameras that could record the perpetrators of the crime.

Subsequently, Dugar Ya.S., acting intentionally as an accomplice in the commission of a crime as part of an organized group, realizing that the information collected by her above would be used by the perpetrators of the crime (Antonenko A.S., Kuzmenko Yu.L. and other unidentified persons) during the murder of Sheremet P.H., foreseeing the occurrence of socially dangerous consequences in the form of causing the death of Sheremet P.H. and wishing for their occurrence, 07/15/2016 around 8:00 p.m. . passing along the route of Pirogova St. – Bohdana Khmelnytsky St. – Ivan Franka St. – Yaroslaviv Val St. in Kyiv, conducted reconnaissance of the streets adjacent to the residence of Sheremet P.G. (No. 12 on Ivan Franka St.) in order to establish the future route of movement of the perpetrators of the crime (approach and departure).

In addition, Dugar Ya.S., acting intentionally as an accomplice in the commission of a crime as part of an organized group, realizing that the information collected by her above would be used by the perpetrators of the crime (Antonenko A.S., Kuzmenko Yu.L. and other unidentified persons) during the murder of Sheremet P.H., foreseeing the occurrence of socially dangerous consequences in the form of causing the death of Sheremet P.H. and wishing for their occurrence, 18.07.2016 in the period from 09:51 to 10:10. здійснила повторну розвідку прилеглих вулиць до будинку проживання Шеремета П.Г. At the same time, Dugar Ya.S., acting intentionally as an accomplice in the commission of a crime as part of an organized group with the same motives and purpose, recorded on her personal mobile phone the external video surveillance cameras along the route traveled (including the video surveillance cameras on the facade of house No. 5 on Lypynskoho Street).

Along with this, unidentified persons from among the accomplices in the organized group, acting intentionally, aware that the above information collected by them would be used by the perpetrators of the crime (Antonenko A.S., Kuzmenko Yu.L. and other unidentified persons) during the murder of Sheremet P.G., foreseeing the occurrence of socially dangerous consequences in the form of causing the death of Sheremet P.G. and wishing for their occurrence, during the period from 07/15/2016 to 07/20/2016 by passing through the streets adjacent to the residence of Sheremet P.G. (No. 12 on Ivan Franko Street), they established a permanent parking space for the vehicle used by Sheremet P.G., a Subaru model “XV” with the license plate «АА1273ЕЕ» – the roadway of Ivan Franko Street in Kyiv, opposite house No. 12.

Subsequently, Dugar Ya.S. and other persons not identified by the investigation, acting intentionally as accomplices in the commission of a crime as part of an organized group, for the same motives and purpose, performing the functions assigned by the organizers, in the period from 07/18/2016 to 07/20/2016, transferred to the organizers of the crime information about the permanent parking place of the vehicle used by Sheremet P.G., a Subaru model XV with license plate number AA1273EE – the carriageway of Ivan Franko Street in Kyiv opposite house No. 12, and a “safe” route of movement for the perpetrators of the crime (approach and departure).

In addition, persons currently unidentified by the investigation, during 2016, but no later than 02:34 on 20.07.2016, acting intentionally as part of an organized group, realizing the socially dangerous nature of their actions and foreseeing the occurrence of socially dangerous consequences, with the aim of further causing the death of Sheremet P.G., realizing that the death of Sheremet P.G. will be caused in a way that is dangerous for the lives of many people, in violation of the above-mentioned requirements of paragraphs 1-8 of the Resolution of the Verkhovna Rada of Ukraine dated 07.06.1992 No. 2471-XII “On the right of ownership of certain types of property”, paragraphs 1-4, 9 of the Regulation on the permit system, approved by the Resolution of the Cabinet of Ministers of Ukraine dated 12.10.1992 № 576 та п. п. 2.8, 8.1, 8.2, 8.9 Instructions “On the procedure for the manufacture, purchase, storage, accounting, transportation and use of firearms, pneumatic, cold weapons, domestically produced devices for shooting cartridges equipped with rubber or similar in their properties non-lethal projectiles, and cartridges for them, as well as ammunition for weapons, main parts of weapons and explosive materials”, approved by order of the Ministry of Internal Affairs of Ukraine dated 21.08.1998 No. 622, illegally manufactured a homemade explosive device consisting of:

  1. EDP-r electric detonator, “hexogen” explosive and striking elements (metal cylinders) of the MON-50 anti-personnel mine
  2. neodymium magnets and a radio-controlled mechanism, which were later transferred to the perpetrators of the crime – Kuzmenko Yu.L. and Antonenko A.S. during the same period.

In turn, Kuzmenko Y.L. and Antonenko A.S., acting intentionally as co-perpetrators of the murder of Sheremet P.G. as part of an organized group, in fulfillment of the roles assigned by the group organizer, realizing that the activation of a previously manufactured explosive device would result in the death of Sheremet P.G. in a manner dangerous to the lives of many people, during 2016, but no later than 02:34 a.m. on 20.07.2016, in violation of the above-mentioned requirements, paragraphs 1-8 of the Resolution of the Verkhovna Rada of Ukraine dated 07.06.1992 No. 2471-XII “On the Right of Ownership to Certain Types of Property”, paragraphs 1-4, 9 of the Regulations on the Permit System, approved by the Resolution of the Cabinet of Ministers of Ukraine dated 12.10.1992 No. 576 and p. p. 2.8, 8.1, 8.2, 8.9 Instructions “On the procedure for the manufacture, acquisition, storage, accounting, transportation and use of firearms, pneumatic weapons, cold weapons, domestically produced devices for firing cartridges equipped with rubber or similar non-lethal projectiles, and cartridges for them, as well as ammunition for weapons, main parts of weapons and explosive materials”, approved by order of the Ministry of Internal Affairs of Ukraine dated 21.08.1998 № 622, without a permit provided by law, they purchased, stored and carried an illegally manufactured explosive device – a homemade explosive device, the components of which were: an EDP-r electric detonator, the explosive “hexogen” weighing 478.4 grams in TNT equivalent, and striking elements (metal cylinders) of a MON-50 anti-personnel mine, neodymium magnets and a radio-controlled mechanism.

Subsequently, on 07/20/2016 at approximately 02:15 a.m. Kuzmenko Y.L. and Antonenko A.S., acting intentionally with the aim of unlawfully causing the death of Sheremet P.G. as co-perpetrators in an organized group, realizing that they were using a method of murder that was dangerous for the lives of many people, in accordance with the distribution of roles determined by the joint criminal plan, which was brought to Dugar Ya.S. and other unidentified persons, having received from the above-mentioned accomplices, including Dugar Ya.S., information about the location of Sheremet P.G.’s car brand “Subaru” model “XV” with license plate “AA1273EE” – the roadway of Ivan Franko Street in Kyiv, opposite house No. 12, while wearing means of concealment in order to prevent their faces from being captured on video surveillance cameras, arrived at the specified place along the “most secure” route from further detection by law enforcement agencies, established in the period 15.07.2016-20.07.2016 Dugar Ya.S. and other accomplices: left the courtyards of the houses on Olesya Honchara Street, where they passed through the courtyards to Yaroslaviv Val Street, from there they turned onto Ivan Franko Street and went to house No. 12.

Having made sure that Sheremet’s car P.G. brand Subaru XV models with license plate «АА1273ЕЕ» is at the specified place, Kuzmenko Yu.L., at approximately 02:39 a.m. acting intentionally as a co-perpetrator of the crime as part of an organized group, being united by a single criminal intent with Antonenko A.S., Dugar Ya.S. and other persons not identified by the investigation at this time from among the organizers and accomplices aimed at unlawfully causing the death of Sheremet P.G., for the same motives and purpose, realizing that she was using a method of murder dangerous to the lives of many people, installed a homemade radio-controlled explosive device with a mass of explosive substance of 478.4 grams in TNT equivalent under the bottom of a car of the brand Subaru XV models with license plate «АА1273ЕЕ» from the outside, in the projection under the driver’s seat.

After that, Kuzmenko Y.L. and Antonenko Y.L., having fulfilled the functions assigned to them by the organizers, left the parking lot of Sheremet P.G.’s car along the “safest” route from further detection by law enforcement agencies, established in the period 15.07.2016-20.07.2016 by Dugar Y.S. and other accomplices: from Ivan Franko St. they turned onto V. Lypynsky St., then through the yards they returned to O. Honchar St., where through Chekhovsky Lane they turned into the block between Bulvarno – Kudryavska and O. Honchara St.

Subsequently, in order to bring the criminal intent to completion, a female person, not yet identified by the pre-trial investigation, acting intentionally as a co-perpetrator of the crime as part of an organized group, being united by a single criminal intent with Kuzmenko Yu.L., Antonenko A.S., Dugar Ya.S. and other persons not yet identified by the investigation from among the organizers and accomplices aimed at unlawfully causing the death of Sheremet P.H., for the same motives and purpose, realizing that she was using a method of murder dangerous to the lives of many people, masking her face with a wig and sunglasses, carrying a backpack with a sports suit placed in advance there, and a radio-controlled device for activating an improvised explosive device, on 07/20/2016 at approximately 07:00 arrived at the street. Ivan Franko and on the territory of the abandoned house No. 17, where she changed into a tracksuit in order to prevent her further identification by law enforcement agencies.

After that, at about 07:21. 20.07.2016 the said unidentified female person, acting intentionally for the same motives and purpose, using the information collected by Dugar Ya.S. and other co-perpetrators of the crime about the victim’s style and lifestyle (time of departure for work, etc.), approached the house of residence of Sheremet P.G. and began visual surveillance in order to make sure that the latter (Sheremet P.G.) would personally get into his own vehicle, under which Kuzmenko Yu.L. at approximately 02:39 a.m. on the same day installed an improvised explosive device.

Later, the said unidentified female person, having ascertained the identity of Sheremet P.G., who left the front door of house No. 12 on I. Franka Street and got into the passenger compartment of his own car “Subaru XV”, license plate AA1273EE, returned to the abandoned house No. 17 on I. Franka Street, from where she continued to visually observe the movement of the said car, which began moving towards the intersection of Bohdan Khmelnytskyi and Ivan Franka Streets.

Later, on 06/20/2016 at 07:39 a.m., a female person, who has not been identified by the investigation at this time, acting intentionally as a co-perpetrator of the crime as part of an organized group, being united by a single criminal intent with Kuzmenko Yu.L., Antonenko A.S., Dugar Ya.S. and other persons who have not been identified by the investigation at this time from among the organizers and accomplices aimed at unlawfully causing the death of Sheremet P.G., for the same motives and purpose, realizing that she was using a method of murder dangerous to the lives of many people, using a radio-controlled mechanism triggered a homemade explosive device, which Kuzmenko Yu.L. at 02:39 a.m. of the same day installed under the bottom of a Subaru car, model “XV” with license plate “AA1273EE”. As a result of the activation of an improvised explosive device, the car in which Sheremet P.G. was located exploded.

After the explosion, a female person, who has not been identified by the investigation at this time, changed clothes and left the crime scene.

As a result of the explosion of a Subaru car, model “XV”, registration number AA1273EE, Sheremet P.G., who was in the passenger compartment, suffered the following injuries:

A) multiple shrapnel gunshot wounds of the upper and lower extremities:

– on the upper limbs, multiple wounds (oval-shaped with uneven, deposited edges that do not reduce due to the “minus tissue” defect in the center, as well as slit-shaped with uneven, non-deposited edges, slightly turned outward): on the front surface of the right forearm in the center and along the inner edge in the upper third, fifteen; on the front surface of the right forearm in the middle and lower thirds, fourteen; on the back surface of the right forearm in the lower third, four; on the back surface of the right hand between the 1st and 2nd and between the 2nd and 3rd metacarpal bones, three; on the palmar surface of the right hand in the projection of the 1st and 2nd metacarpal bones, two; one on the palmar surface of the proximal phalanx of the 2nd finger on the right hand; one on the back surface of the left shoulder in the lower third; one on the left forearm on the back surface in the upper third; two on the back surface of the left forearm in the lower third. The wound channels from all these wounds are mainly directed from bottom to top, some from back to front, some from right to left, others from left to right, damaging the soft tissues, the right ulna and right radius in their course, some of them connect and intersect with each other, some of them end in the soft tissues, in which multiple metal foreign bodies are found. The depth of the wound channels is from 1 cm to 18 cm.

– on the lower extremities, multiple wounds (similar in morphology to the above): one on the back surface of the right thigh from the middle to the lower third; on the front and inner surface of the right thigh in the upper and middle third in the amount of seven; on the back and inner surface of the right shin in the upper third in the amount of four. The wound channels from all these wounds are mainly directed from bottom to top, some from back to front, right to left, others from left to right, damaging the soft tissues along their course, some of them connect and intersect with each other, some of them end in soft tissues, in which multiple metal foreign bodies are found. The depth of the wound channels is from 2 cm to 25 cm.

– widespread tissue defect with rupture of the femoral artery and vein, with damage to the femoral and fibular bones, with a laceration wound on the left leg from the middle third of the thigh to the lower third of the shin, covering the posterior and lateral surfaces, with the placement of subcutaneous fat along the border of the defect, with muscle tears (stained bright red, and with the application of an oily gray-black substance).

  1. B) areas of yellow-brown color, with clear boundaries, parchment density, with areas of bulging of the epidermis in the center, which has charred black edges:, on the front surface of the abdomen on the right, from the costal arch to the mesogastric area; from the inguinal area on the right to the middle third of the right thigh, covering the front and inner surfaces (thermal burns of the 3rd degree), with a total area of ​​more than 15% of the entire body surface.

C) a slash (with uneven, slightly deposited edges, sharp ends connected by tissue membranes at the bottom and hilly walls) wound on the face in the frontal area on the right; small incised (with smooth, slightly deposited edges, sharp ends, and relatively smooth walls) wounds: in the area of ​​the head, body, and tail of the right eyebrow, as well as in the area of ​​the head of the left eyebrow; on the upper eyelid of the right eye; in the left zygomatic area; on the left cheek; on the front surface of the right neck in the upper and middle thirds; on the back and outer surface of the left shoulder in the upper and middle thirds; multiple abrasions and bruises: on the back and outer surface of the left shoulder and forearm; on the back, front, and inner surfaces of the right thigh and lower leg; on all surfaces of the left thigh and left lower leg; multiple scratches on the back and outer surface of the left shoulder in the middle and lower thirds.

D) uneven blood supply to internal organs; streaky hemorrhages under the endocardium of the left ventricle of the heart (Minakov’s spots).

Sheremet P.G. died from an explosive injury: multiple shrapnel wounds to the upper and lower extremities with damage to soft tissues, bones, large vessels, with blood loss and shock.

By their joint and coordinated actions, Antonenko A.S., Kuzmenko Yu.L., Dugar Ya.S. and persons not identified by the pre-trial investigation, who acted as part of an organized group, committed the intentional murder of Sheremet P.G.
